Terms of Service
These Terms of Service govern your use of the 3pm German Baking website and your purchases from 3pm German Baking, LLC ("we," "us," or "our"). By placing an order or using our website, you agree to these terms.
Products
All our products are handmade in small batches using traditional techniques. As a result, individual items may vary slightly in appearance, size, and decoration.
Product availability and prices are subject to change without notice. Market menu items are available while supplies last.
Allergen Notice
⚠️ Important: All of our products are prepared in a kitchen that handles gluten, dairy, eggs, nuts, soy, and other common allergens. While we take care to label products with known allergens, we cannot guarantee that any item is completely free of any allergen due to the shared kitchen environment.
If you have severe allergies or dietary concerns, please contact us before ordering so we can discuss your needs.
Orders
Market orders: Products are available first-come, first-served at our farmers market table.
Direct orders: Orders placed directly with us are confirmed via email or phone. A confirmation constitutes agreement to the terms of the order.
Wholesale orders: Wholesale orders are confirmed via invoice and are subject to the terms stated on the invoice.
Payment
Market sales: Payment is collected at the time of purchase at the market.
Direct orders: Payment terms are communicated at the time of order.
Wholesale orders: Payment is due according to the net terms stated on the invoice.
Delivery
Delivery is available for direct orders within the Asheville, North Carolina area. Delivery fees vary based on distance and are quoted at the time of order.
We are not responsible for delays caused by circumstances beyond our control.
Refunds and Replacements
Quality issues reported within a reasonable time will be offered a replacement at our next market or delivery. No cash refunds.
Liability
3pm German Baking, LLC is not liable for:
- Allergic reactions or other health issues resulting from consumption of our products
- Damage to or loss of products after they have been picked up or delivered
- Incidental or consequential damages arising from the use of our products
Governing Law
These terms are governed by the laws of the State of North Carolina. Any disputes shall be resolved in the courts of Buncombe County, North Carolina.
Changes to Terms
We reserve the right to update these terms at any time. Changes will be posted on this page with an updated effective date.
